Buyer Companion Contract
Muddy Creek Kennel German Shepherds, hereafter referred to as the Sellers, hereby agree to sell and transfer ownership
and possession of the dog described below to __________________________ hereafter referred to as the Buyer, for the purchase
price of $ with the following conditions and warranties; no other warranties or conditions either expressed or implied:

The above dog is purebred German Shepherd dog; registerable with the UKC and that a limited registration application or
individual limited registration has been given to the Buyer as of the date of purchase.
The above describe dog may for any reason be returned prepaid to Seller with in 24 hours, or as otherwise agreed in writing,
at the time of receipt, Buyer shall assume full responsibility for the health, anatomical make-up, appearance and temperament
of the above described dog during the said 24 hour period. If the condition of the dog has changed in any of the categories
mentioned in the previous sentence, the Seller is relieved of obligation to return the full amount of the purchase price;
otherwise the full purchase price will be refunded.
Warrantee:
Seller warrants that dog is in good health for 72 hours after delivery to Buyer. If dog is discovered not to be in good
health by Buyer within 72 hours after receipt of dog, and attested to in writing to seller by an independent licensed veterinarian,
Seller shall provide Buyer with a replacement puppy of like quality as soon as such a dog is available or to refund, at the
discretion of Seller the purchase price upon the return of the dog to Seller.
Seller warrants that Dog has received appropriate medical care, including shots and worming as of the date of this Agreement.
Seller will provide Buyer with a medical chart detailing treatment Dog has received under Seller's care and future care Seller
feels is essential to Dog's well being.
Seller Warrants to the best of Seller's knowledge, the above-described puppy is progeny of animals that are healthy and
show no signs of any congenital defects. A congenital defect is more commonly known as a birth defect. Most are present at
or near birth. Seller guarantees the above-described puppy against life-threatening congenital defect until this puppy is
2 years old. This is a limited guarantee and the Seller must be notified, in writing, when the congenital defect is first
detected. This guarantee is unenforceable after the puppy passes the age of two (2). If a claim for a life-threatening congenital
defect is made, written verification on letterhead from a qualified, licensed veterinarian must be provided to Seller with
a description of the puppy's congenital defect and their opinion as to seriousness of the defect. Seller reserves the right
to have the puppy re-inspected by its own veterinarian for confirmation of the defect before replacing the puppy. In this
event, the puppy will be replaced with a comparable replacement when one becomes available. Comparable replacement will be
like sex and color. Buyer is solely responsible for any and all delivery and/or shipping related expenses. UNDER NO CIRCUMSTANCES
WILL SELLER BE OBLIGATED TO BUYER FOR A CASH REFUND OR VETERINARIAN COSTS.
Seller warrants that said dog should be free of crippling hip and elbow dysphasia to the age of 2. If a preliminary x-ray
or an OFA x-ray is done and the vet feels that the hips or elbows are of congenital crippling nature and the dog will not
pass OFA, then the vet must send the x-rays to my kennel with the paperwork. We will send the x-rays onto the OFA to determine
whether congenital crippling dysplasia is present after reviewing them. If the vet does not want to do this, then the owner
must ask for a copy of the x-rays so they can be sent to my kennel. No dog will be replaced without us viewing a set of the
x-rays. There is NO EXCEPTION to this policy. We have replaced too many dogs with good hips based on a local vets or a Buyers
opinion. If the dog does have bad hips I need to see the x-ray to determine what level of problem exists. This information
is used to determine what actually happens to the dog. (i.e. are the hips so bad that the animal will be in pain, or are the
hips not good enough to breed but it can live a normal life as a family dog).
Seller warrants that the dog's ears will stand. If they are not standing by 4 1/2 months, the owner must contact Seller.
The ears must be taped for a period of 4 weeks starting at 4 1/2 months, after 4 weeks of taping the owner must again contact
Seller and dog must again have the ears taped.
A pup will not be replaced for soft ears unless these procedures are followed and have been documented in writing. If a
new owner takes the necessary precautions to tape weak ears 99.9% of the time they will stand. It is entirely possible to
have a dog whose ears would have stood had they been taped, but they did not stand because the owner has not done his or her
share in making sure the ears were properly taken care of.
Customers should know that ears may come up and then go back down when the dog begins to get his adult teeth (at 4 to 5
months). If this happens the ears will ALWAYS come back up after teething.
If the Seller is satisfied that the above described dog is unsuitable for the purpose sold because of conditions outlined
in the warranty section of this agreement, the Seller will replace said dog with one of comparable value and qualities at
their earliest convenience. In either case, the unsuitable dog will, at the discretion of the Seller, be returned to the Seller
at the expense of the Buyer.
Buyer Agrees:
Buyer understands and agrees that the above described dog is being sold as a pet/companion and no breeding rights are being
conveyed.
The Buyer agrees to permanently register, utilizing the "Limited Registration" provided with the United Kennel Club using
the pre-selected name the Seller has chosen; and to provide good care, both physically and emotionally, to the dog as follows:
Buyer agrees to have dog examined by a licensed veterinarian within 72 hours (not including weekends and holidays) of receipt
of the dog. Failure to have the puppy inspected by a certified veterinarian, within 72 hours of receipt (3 business days)
of the above-described puppy voids any and all health warrantee.
To provide a fenced yard to prevent the dog from running the streets without chaining or tethering the dog.
To provide the care of a qualified veterinarian in the case of illness or injury and for preventative health care.
To provide shelter from the weather both in winter and in summer.
To, in general, care for this dog physically AND emotionally as the loving, totally dependent living being that the dog
is.
To contact the Seller for advice and/or assistance if, for reasons beyond the buyer's control, the buyer finds that the
above conditions cannot be adequately met.
To contact the Seller in writing and offer the seller the right of first refusal should the buyer decide to transfer possession
or ownership of the dog.
To provide seller with any and all change of address or phone number during the dog's life.
The Buyer understands that he/she is purchasing a dog of exceptional breeding and that responsible breeders of this breed
do all in their power to protect the breed from degradation and harm; and that he/she is purchasing this dog from breeders
whose reputation could be tarnished from the irresponsible actions of Buyers. The Buyer further understands and agrees that
any willful or substantial violation of the above agreement and that transfer or disposal of the dog without adhering to the
terms of the agreement will result will result in a liability of three times the purchase price of the dog, at the sole and
absolute discretion of the seller.
Acceptance:
By signature below, the Buyer(s) and the Seller affirm that they have read and understand this agreement and will abide
by the articles of this agreement.
